SPONSOR: The BlueChew Sneaker Giveaway ("Giveaway") is sponsored by BlueChew.
ELIGIBILITY: This Giveaway is open only to legal residents of the 50 United States or the District of Columbia who enter and who are 18 years of age or older as of the date of entry. Employees of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
AGREEMENT TO OFFICIAL RULES: By participating, all entrants fully and unconditionally agree to and accept the Official Rules. In addition, you agree to accept the decisions of Sponsor as final and binding as it relates to all matters of this Giveaway.
GIVEAWAY PERIOD: The Giveaway begins on July 26, 2023 at 12:00 pm CDT ("Start Date") and ends on September 15, 2023 at 11:59 p.m. CDT ("Closing Date"). Sponsor’s computer is the official time keeping device of the Giveaway.
HOW TO ENTER: The Giveaway can be entered by clicking on the Enter CTA in the promotional (where applicable) and providing a valid email address or via the Twitter CTA posting by: 1) Liking 2) Retweeting 3) Commenting. Each of these actions counts as a unique entry. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete, do not adhere to the rules, or do not provide the requested information may be disqualified at the sole discretion of Sponsor. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Sponsor. Entries become the property of Sponsor and will not be acknowledged or returned. Entries may only be submitted after the Giveaway Start Date and before the Giveaway Closing Date.
PRIZES: There will be a total of 2 winners. The Winner of the Giveaway (the “Winner”) will receive one (1) pair of customized NIKE® sneakers. Approximate retail value (“ARV”) of each prize is $300. Total ARV of all Prizes is approximately $600.
LIMITATIONS ON PRIZES: Limit one (1) prize per entrant. Sponsor reserves the right to substitute a prize (or portions thereof) of equal or greater value if prize (or portions thereof) cannot be awarded as described. The specifics of the prize shall be solely determined by Sponsor. No cash or other prize substitution shall be permitted except at Sponsor's sole discretion. The prize is non transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. PRIZES ARE AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE EXPRESS OR IMPLIED. SPONSOR DISCLAIMS ALL AND ANY LIABILITY FOR THE ACTUAL PROVISION, QUALITY OR NATURE OF ANY THIRD-PARTY PRODUCT OR SERVICE ACCEPTED BY THE WINNERS. The awarding of any prize is contingent upon full compliance with these Official Rules. In the event a potential winner is disqualified, he/she shall forfeit his/her prize, and Sponsor reserves the right in its sole discretion whether to select an alternative winner.
ODDS: The odds of winning depend on the number of eligible entries received.
WINNER SELECTION AND NOTIFICATION: Winner will be selected by a random drawing under the supervision of Sponsor. Winner will be notified by email and/or Direct Message only to the email address and/or Twitter account provided in the entry within five (5) days after the Closing Date. Sponsor shall have no liability for Winner’s failure to receive notices due to spam, junk email or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within five (5) days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate Winner selected. Receipt by Winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED. PRIZE DELIVERY: Prizes will be mailed to the street address provided by the Winner in reply to the notification within four to six weeks of the close of the Giveaway. Any prizes returned as undeliverable will not be awarded. Any difference between the stated ARV and actual value, if any, will not be awarded.
RIGHTS GRANTED: By entering this Giveaway, you understand and agree that BlueChew, anyone acting on behalf of BlueChew, and BlueChew’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. Void where prohibited.
OTHER: Sponsor assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures, or any other reason, or incomplete, damaged, misdirected, illegible, stolen or lost entries. Sponsor reserves the right, in its sole discretion to disqualify any person tampering with the entry process, the operation of the web site or otherwise, in violation of the rules.
CAUTION: Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Giveaway is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such individual to the fullest extent permitted by law. Sponsor reserves the right to disqualify any non-conforming entries. Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this promotion if not capable of completion as planned, including infection by computer virus, technical corruption, non-authorized human intervention or force majeure. In the event of cancellation, Sponsor reserves the right to select winners from among all eligible entries received prior to the date of cancellation. The use of automated entry systems or any other conduct that impedes the integrity of the Giveaway is prohibited. In the event of a dispute regarding online entry, entry will be deemed made by the authorized account holder of an established email account associated with the entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet Access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
RELEASE OF LIABILITY: By entering, you agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, attorneys, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Giveaway; (v) electronic or human error in the administration of the Giveaway or the processing of entries. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Giveaway or in the announcement of the prizes. Decisions of Sponsor are final and binding in all respects. DISPUTE RESOLUTION: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE STATE OF ILLINOIS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the State of Illinois, Cook County having jurisdiction, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action.
